The 183-day rule for tax residency: it is not one rule

Checked

"Stay under 183 days and you are not a tax resident" is repeated everywhere. It is only partly true. 183 days shows up in many tax systems, but each country defines it differently, and day count is rarely the only test. Three official examples:

Spain: more than 183 days in the calendar year, or your centre of interests

Article 9 of Spain's personal income tax law (Ley 35/2006) treats you as a resident if you spend more than 183 days in the calendar year in Spain. Sporadic absences are counted as days in Spain unless you prove you are tax resident in another country. You are also resident if your main base of activities or economic interests is in Spain, and it is presumed, unless proven otherwise, if your non-separated spouse and dependent minor children live there habitually.

United Kingdom: the Statutory Residence Test

The UK tax year runs from 6 April to 5 April. You are resident if you meet an automatic UK test or the sufficient ties test, and none of the automatic overseas tests. Spending 183 or more days in the UK is an automatic UK test. Fewer than 16 days (46 if you were not resident in the previous three years) is an automatic overseas test. There are also tests about work and about a UK home.

United States: the substantial presence test

You are a US resident for tax purposes if you were present at least 31 days this year and the weighted total over three years reaches 183: all days this year, one third of last year's and one sixth of the year before. Some visa categories are exempt, and the closer connection exception may still apply.

What this means for you

Use the 183-day calculator to see your day count for each of these rules. It is a counting aid, not tax advice: check with the tax authority or an adviser in the country that matters to you.
